Playa Setup Concierge (the “Company,” “we,” “us,” or “our”)

These Terms & Conditions (“Terms”) govern your access to and use of our website and
services. By booking, purchasing, or using our services, you agree to these Terms.
1) Who We Are
We are a Mexico-based team and long-term Riviera Maya locals providing relocation
and concierge coordination services in Riviera Maya, including Playa del Carmen,
Puerto Morelos, Tulum, and Cancún.
2) Definitions
● “Client,” “you,” “your”: the person purchasing or using our services.
● “Services”: concierge/relocation coordination, guidance, scheduling,
accompaniment (if applicable), and related support as described on our
website or invoice.
● “Third-Party Providers”: independent vendors (internet providers, technicians,
landlords, movers, contractors, etc.) we may introduce to you or coordinate
with at your request.
3) Scope of Services
Our Services may include (depending on what you purchase):
● Relocation planning and coordination
● Home setup coordination (utilities, internet scheduling, basic setup checklists)
● Appointment scheduling and accompaniment (when purchased)
● Translation support and local navigation support
● Recommendations and introductions to Third-Party Providers
● WhatsApp or messaging support during the service window (if included)
Important: We provide coordination and guidance, not guaranteed outcomes.
Timelines and results can be affected by Third-Party Providers, government
processes, availability, weather, and other factors outside our control.
4) What We Do Not Provide
Unless explicitly stated in writing, we do not provide:
● Legal advice, immigration advice, tax advice, or financial advice
● Real estate brokerage services or representation as a licensed broker
● Guarantees regarding approvals, permits, visas, banking outcomes, or
government decisions
● Direct responsibility for Third-Party Providers’ work, pricing, safety, warranties,
or performance
If you need legal/immigration/tax guidance, you should consult a qualified
professional.
5) Eligibility
You must be at least 18 years old to purchase Services. If you request services
involving minors, you represent that you are their parent/legal guardian or have
permission to act on their behalf.
6) Booking, Communication, and Client Responsibilities
To deliver the Services, you agree to:
● Provide accurate and complete information (names, dates, addresses, ID
details when needed for appointments, etc.)
● Respond in a timely manner to requests for approvals, confirmations, and
decisions
● Treat our team and Third-Party Providers respectfully
● Follow safety instructions and local regulations during in-person
accompaniment
Delays caused by missing information or lack of responsiveness may impact
timelines and availability.
7) Fees, Currency, and Taxes
● Prices are shown on our website and/or in your invoice.
● Fees may be listed in USD for convenience; local charges by vendors may
occur in MXN.
● You are responsible for any bank fees, foreign transaction fees, or
exchange-rate differences.
● Unless stated otherwise, you are responsible for applicable taxes required by
law.
8) Payments
● Some Services require full payment upfront; others may require a deposit. This
will be stated at checkout or on your invoice.
● We reserve the right to pause or withhold Services until payment is received.
9) Changes, Rescheduling, and Client No-Shows
Because our work involves scheduling time and coordinating calendars:
● Rescheduling requests must be made as early as possible.
● If you miss an appointment or are unavailable at the agreed time, that time
may be forfeited.
● Any additional time beyond what you purchased may be billed at our
then-current hourly rate (or quoted as an add-on).
10) Cancellation & Refund Policy
Because our services involve time-based planning and coordination, refunds depend
on how much work has already been performed.
General policy (recommended):
● If you cancel before we begin work: refund minus processing fees (if any).
● If work has started (planning, booking, vendor outreach, itinerary building,
appointments scheduled): we may issue a partial refund based on work
completed, or convert remaining value into a credit.
● If the service is time-based and the time window has begun: unused time is
typically non-refundable.
Third-party costs: Any fees paid to Third-Party Providers (deposits, service fees,
reservations) are subject to their refund policies and may be non-refundable.
Note: Consumer rights in Mexico may provide additional protections in certain
situations. Consumer matters may be handled by PROFECO (Mexico’s consumer
protection authority).
11) Third-Party Providers and No Endorsement
At your request, we may recommend or coordinate with Third-Party Providers. You
understand and agree:
● Third-Party Providers are independent and not our employees or agents.
● We do not control their pricing, availability, quality, safety standards, or
warranties.
● Any contract for third-party work is between you and the provider.
We can help you compare options and communicate clearly, but the final decision is
yours.
12) No Guarantees
We aim to provide a smooth experience, but we cannot guarantee:
● Specific outcomes, approvals, or completion times
● That a vendor will perform to your expectations
● That pricing will remain unchanged after quotes (vendors may update pricing)
13) Liability Limitation
To the maximum extent permitted by law:
● We are not liable for indirect, incidental, special, consequential, or punitive
damages.
● Our total liability for any claim related to the Services will not exceed the
amount you paid us for the specific service that gave rise to the claim.
14) Indemnification
You agree to indemnify and hold harmless the Company from claims, damages,
liabilities, and expenses arising from:
● Your misuse of the Services
● Your breach of these Terms
● Your interactions/contracts with Third-Party Providers
15) Force Majeure
We are not responsible for delays or failures caused by events beyond reasonable
control, including weather, natural disasters, power or internet outages, strikes, road
closures, government actions, vendor shutdowns, or emergencies.
16) Confidentiality
We may handle personal details needed to coordinate your services. We will take
reasonable steps to keep your information confidential and only share it as needed to
fulfill your requests (e.g., with a vendor to schedule installation).
17) Intellectual Property
All website content, checklists, guides, templates, and written materials we provide
are owned by the Company and are for your personal use only. You may not
reproduce, resell, or distribute them without written permission.
18) Reviews and Testimonials
If you provide a review, testimonial, or feedback, you grant us permission to use it for
marketing purposes (website, social media, proposals), unless you explicitly request
otherwise in writing.
19) Website Use
You agree not to:
● Use the website for unlawful purposes
● Attempt to interfere with site security or functionality
● Copy or scrape content without permission
20) Governing Law and Disputes
These Terms are governed by the laws of Mexico. Any dispute will be handled in the
competent courts located in Quintana Roo, unless mandatory consumer law
provides otherwise.
21) Changes to These Terms
We may update these Terms from time to time. The “Last updated” date will reflect
changes. Continued use of the Services after updates means you accept the revised
Terms.
